A Step-by-Step Overview of Section 4
The invocation of the 25th Amendment is a rigorous process requiring high levels of consensus:
- Initiation: The Vice President and a majority of the “principal officers of the executive departments” (the Cabinet) must provide a written declaration that the President is unable to discharge the duties of the office.
- Transfer of Power: Upon the delivery of this declaration to the President pro tempore of the Senate and the Speaker of the House, the Vice President immediately assumes the powers and duties of the office as Acting President.
- Presidential Response: The President may submit a written declaration stating that no inability exists, resuming power unless the Vice President and Cabinet object within four days.
